Spending months in quarantine has already dramatically impacted design, with new trends that will undoubtedly continue to resonate well into 2021 and beyond. The future of interior design will reflect the reality of a world that has been forever changed by incorporating cleanliness and materials to help to mitigate the spread of disease, floor plans that provide separate spaces for home-bound activities, and a focus on personal well-being.
Nature-starved homeowners have been craving what they’ve been denied of late, so expect to see an increased number of plants and lush indoor gardens, earth-toned color schemes, outdoor-style interior flooring, and even the occasional attached greenhouse.
Residences will no longer have a home office, but an office at home. Significant reconsideration of how we can create a beautiful, functional office at home will be designed and set up to accommodate full time satellite workplaces.
If you’re doing your part and social distancing from inside your home, you may start to notice small details of your house or apartment you hadn’t thought about before – like how to help keep your home as clean as possible during the corona virus outbreak. There are few materials that we can use that are more sterile than others and will be used even more in the future of design.
        • Metals such as copper, brasses, and bronzes are natural antimicrobial materials that have intrinsic properties to destroy a wide range of microorganisms. Not only are these metals hygienic, but they are great accents to warm up your home.
        • A separate “casita” or guest house suite can be useful for isolating someone that may be ill, or to provide more distance and privacy for guests.
        •  Office spaces and study areas are more necessary than ever. As more of us work (and learn) from home, a dedicated office and space for studying is essential. Many of us quickly had to convert areas and rooms to our own home offices – showing us the importance of a separate space. Homes with multiple areas for getting work done – offices, libraries, and study areas – will be even more popular in design.
        • Multiple areas for activities and entertainment, such as home gyms, media rooms, and game rooms will be necessary to keep everyone entertained. During this pandemic, we have found ourselves with a lot of time on our hands, so whether it’s a family game night or a workout, the need for a space for everyone at home has only increased.
        • There’s no doubt that the future of kitchen design will look different in a post COVID 19 world. First, we have been forced to alter the way we shop, store, and prepare food. Second, we have more time at home to get organized, tackle lingering projects, and sanitize our homes. Finally, we have had to change the way we interact and socialize with family, friends, and colleagues. More long term storage and larger freezer capacity are in demand. New kitchens will be designed with cleanability in mind. Low maintenance cabinet finishes, faucets, tile, and fixtures will be a top priority. Quartz is one of the hardest non-precious stones on earth, therefore countertops made from quartz are hard, stain and scratch-resistant, and the most sanitary.

Our living spaces greatly influence our physical health – as well as our emotional state of mind (especially during his time). So it will continue to be important to create environments that stimulate our senses in a good way, improve relaxation, and have health and wellness benefits to the people using them. Here are a few ways of living that will be popular.

  • Bringing in nature will be emphasized in many different ways. From larger windows with views outside and using colors that reflect the natural world. Having lots of greenery in a home is also an obvious and easy stimulant to our overall wellbeing (along with lots of health benefits).
  • An increase in organization. Being quarantined at home makes us realize what is really necessary. Clutter can cause anxiety and discomfort – feelings that are more unwanted than ever. Organization will be emphasized, through de-cluttering, smart storage, and built-in shelving and spaces for keeping items organized in smaller spaces.
  • A sense of security and calm will definitely be present in interiors. When the world is full of uncertainty, having a space that feels like an escape from the outside world, with soft and cozy materials, light colors and relaxing vibes, will be a prerequisite of design.

When it comes to colors this year, we’re seeing the return of earth tones in a wide spectrum, from cream to terra cotta.  Expect to see decor that conveys softness, with plenty of light colors, especially pinks, beiges and other neutral tones, for a Zen look promoting rest, tranquility and well-being.

Nature continues its influential role in the world of decor. Vegetal hues have been in the spotlight for several seasons now, and this year we saw a lot of them, ranging from tender green to intense mint to peacock blue. Sky blue has brightened up the pastel palette.

Earth tones aren’t the only trend with staying power of late. While black is becoming less popular, blue has been replacing it. It’s a more versatile and emotionally indulgent hue well suited to sheltering at home.

Rates are lower than ever; when a refinancing is done right, it can save you thousands of dollars. But not every potential refi makes the cut. Sometimes the expenses just don’t justify the potential savings.

It is time to refinance your home mortgage if the terms lower your mortgage interest rate, pay off their mortgage years earlier, or saves thousands in interest over the life of the loan. You can save serious money by refinancing your mortgage. But due to refinancing fees and expenses, not every refi makes financial sense.

COVID-19 is creating changes with lenders and how they are doing business. This is resulting in refinancing taking longer and getting stricter than it has been in the past. Although the mortgage process is considered essential as a financial transaction, depending on where you live, there may be changes related to COVID-19  involving your appraisal, rate lock and closing process.

Rates are quite low and because your home is your biggest financial investment, the equity can be very useful as a resource in times of trouble. But if you’re thinking of financing your home loan there are several steps you should take to make sure that it’s the right move for you.

How Long Do You Plan On Being In Your Home?

Being able to answer this question will help you figure out the term length you want on any refinanced mortgage; but there’s another reason asking this question …

If you plan on moving within the next 5 – 10 years, it could be worth your while to look at an adjustable rate mortgage ( ARM).  You get a lower rate initially with an ARM because the rate can adjust after the teaser period. But if you move before the end of the fixed-rate time frame, you don’t have to worry about whether the rate is going up and down in the end. Additionally, your payment will tend to be lower because most adjustable rate mortgages are based on 30-year terms.

Age Of Current Loan

The age of your current loan sometimes plays a role in whether you can refinance. Even if you can refinance, it does not always make sense.  When you refinance you have to pay closing costs.  If you are not planning on staying in the house past the breakeven point when the savings and the additional expenses paid starts to net to overall reduced costs for home ownership, the it is not the time to refinance.  You may want to accelerate buying a new home to realize the saving from lower interest rates.

Plans For Monthly Savings

If you determine that you’re going to save money by refinancing based on the rate and term you can get, make sure that you have a plan for what you’re going to do with the monthly savings in order to put yourself in a better financial position. No one knows exactly when COVID-19 is going to end and how long it will take for the economy to recover. If you can save money now, you can work on establishing the savings need should the vaccine be delayed or we continue with a longer recession

You could use your savings to build up an emergency fund. Maybe you choose to allow yourself to save money in the future by paying off high-interest debt now. You can also use this to catch up on saving for retirement if you stopped contributing temporarily while dealing with the situation caused by the virus.

The Mortgage Refi Process

Approving a mortgage is a complicated process, one that requires a lender to validate a borrower’s income, check the value of the home being used as collateral and scrutinize the title history of the property.

Just as refinancing applications picked up, the coronavirus pandemic dramatically changed the way everyone in the mortgage industry works. Loan officers no longer go to the office. Appraisers stopped walking through houses. And no one gathers around the title company’s closing table. The process is a little slower because everybody’s working from home right now. Things that would take an hour to do are taking a day sometimes.

It is more difficult to verify a borrower’s employment. A task once dispatched with a quick call to the borrower’s human resources department now means leaving a voicemail and waiting a day or two for a response.

Meanwhile, homeowners looking to refinance may have to get in line behind buyers who need a mortgage so they can close on a house which are a priority with lenders.

The mortgage industry already had been digitizing, and lenders quickly adapted to many changes. One stumbling block, though, is that most lenders still require some documents to be signed in the presence of a legal witness and notarized.  Florida allows for mobile notaries and they are busier than ever.

Sometimes, documents are being signed remotely and online and mobile notaries are not allowed yet.  You need to allow time for in person notarization and overnight mailing of documents.  Digital closings may be the way of the future, but we are not there yet.

What You Can Do to Secure a Smooth Refinance

Here are a few ways you can make the refi process as smooth as possible:

— Get your paperwork in order. Don’t let something simple like a missing document delay your refinance. Collect PDFs of financial documents, including pay stubs, bank statements, tax returns and retirement accounts.

— Make sure the lender will honor your rate lock. In normal times, lenders extend rate locks for 30 to 60 days, meaning you won’t have to pay more if rates go up before your loan closes. These aren’t normal times, though, and many refinances aren’t closing within 30 to 60 days, so make sure your lender is willing to extend your rate lock if your deal is delayed.

— Keep your credit score tight. Now isn’t the time to miss a payment, take on new debt or otherwise do anything to lower your credit score. Lenders are being especially strict about borrowers’ credit histories.

 

How To Set Up A Home Office

I’ve spent more than three decades with a home office. When you work at home, even part time, you discover that a makeshift desk area on a kitchen counter or the dining table isn’t the best setup. Having a dedicated home office, even if it’s compact, makes a big difference in comfort and productivity. Having a dedicated space also serves as an important signal to those who live with you that you’re ‘at work’. Create boundaries within your home that your family members understand.
Stake Out Your Spot 
You need to pick a spot in your home with the fewest distractions, and where all the essentials (like electrical outlets and your modem) are close by. Modern WiFi is a wonderful thing but understand it can still be inconsistent in even the most tech-friendly neighborhoods. I anticipate that our connectivity speed will be further degraded by all the streaming and game-playing that is happening now, in addition to everyone trying to work from home as well……be patient and see if you can upgrade to a higher speed with your home Internet provider.
Also, try to find a spot near a window with some natural light so you don’t feel completely tucked away from the world. Think about storage and try to keep work-only items grouped together. Think outside the file box to find an organizational system that works for you; see what you can use around your home. It’s more important to give everything that has been sitting out in piles a permanent home than it is to buy new containers. Here are a few ideas for organizing your home office:
·     A grid of clipboards on the wall can make for a handy place to keep papers organized.
·     Wall-mounted cups keep frequently used supplies neat and within reach.
·     Cups and bowls borrowed from the kitchen make great desktop and drawer organizers.
·     Labeled, open-top baskets on shelves are great for people who like piles
·     Traditional files are still useful for important documents.
Set Ground Rules with the People in Your Space
Set ground rules with other people in your home or who share your space for when you work. I say “morning,” but not everyone who works from home follows a nine-to-five schedule. Yours might be a “getting started” routine at another time of day. I want my elderly parents to be able to call me anytime, but have reminded them that “after 6” is the best time to get my undivided attention. I ask other family members and friends to respect my work hours and stick with the less obtrusive email or text for non-emergencies.
Act as if you are “going to work”. Whatever your routine was when you were going to the office, try and maintain it now that you are working from home. Exercise, shower, get dressed (not pajamas), and then “go to work”. I try and avoid eating at my desk and taking a coffee break, lunch break, etc.  Use these times to reconnect with other household members and address their needs and concerns.
Think About Your Back, Feet and Shoulders 
Pick a back-friendly, ergonomic chair if at all possible and always make time for exercise (don’t forget to stretch!). I prefer to stand or walk around while I am on the phone but now that my husband is working from home as well, we find that this is distracting to one another. Go outside and get some fresh air while on that call.
Although you can easily work on a laptop from anywhere, an entire day, week, or even a month spent looking down at a screen is not going to do your neck muscles any favors. If you have the space and the budget, think about upgrading to a decent-sized computer monitor to plug your laptop into. I use two monitors so that I can multitask between emails, software applications required for my work, calendars, and more.
Most desks, chairs and monitors and still designed for the average sized man. I have made adjustments by ensuring that my monitors are at eye level. You can use boxes, books, magazines or anything you have around the house to easily accomplish this…no need to be purchasing special desks, risers, etc. If your chair is not adjustable, use pillows, etc. to ensure that you are sitting at the right height to keep your back straight. I have purchased an ergonomic cushion that provides comfort and support for my spine as well as adds two includes to my seat height.
Make Friends with Your Postal Worker or Delivery Person 
Thank goodness for USPS, UPS and FedEx!!! These people get bonuses at Christmas for their daily deliveries to my door. I have always been an online shopper for convenience and time-saving and now that I am getting deliveries for food, office supplies and more the visits to my front door have increased ( still can’t find toilet paper however).
Take the time to let your local postal worker or delivery person in your neighborhood know you’re now working from home if your work involves a lot of envelopes and packages. I have made a point in the past to have a few daily words with the drivers that frequent my home. It helps when my local delivery person knows I’m working at home and sending and receiving envelopes and packages on a regular basis.  In today’s world something as simple as leaving a note on your door explaining your situation will work and be appreciated.  My UPS driver told me a couple of days ago that I can leave the package outside my front door with a note to pick it up or if I see him in the neighborhood to just hand him the box…..no need to go out to the UPS store!!!
Pump the Brakes with Social Media
Social media can be absolute poison if you don’t limit yourself. It’s definitely good to stay on top of the news during these uneasy times, but if you allow yourself to be sucked into endless posts, you might look up at the clock and discover you lost three or four hours of your day.
I enjoy social media and participate for both personal and work reasons, but I have learned to use it wisely.  I check it before I head to my office with my morning coffee and then again at the end of the day. That doesn’t mean you can’t laugh at someone’s funny online story, or post about your favorite sports team or TV show. Just try to limit the damage during work hours.
Freshen up.
Give yourself a big pat on the back, because the hardest work is now behind you! Today is all about making your home workspace fresh and clean, so it will be a healthier, more pleasant place to spend time in.
·     Vacuum your home office from top to bottom. Use an attachment to clean window treatments, high corners and fabric lamp shades.
·     Wipe down shelves and surfaces with a damp microfiber cloth.
·     Use monitor wipes to clean your screens.
·     Use a keyboard cleaner to blow dust from between the keys or gently clean them with cotton swabs.
·     Bring in some fresh plants to help clean the air.
Straighten up your home office before you are done working each day. Bring the coffee cups back to the kitchen and completely clear your desktop.
We are all anxious and a routine will help keep our life as “normal” as possible in these difficult times. Don’t be hard on yourself if you are not as productive as when in the office. Working from home is a mindset and a discipline and cannot replace a normal work environment. It takes time, discipline and commitment to find the right balance for your personal and family needs.

Condo dwellers can also typically take advantage of shared amenities, plus having professional management to take care of building maintenance.
However, condos aren’t for everyone so it’s best to figure out what your lifestyle and budget needs are first.
Whether you are purchasing a vacation condo or making South Florida your permanent home, there are a few tips and tricks you should use to help make the condo buying decision easy and stress-free.
Here are just a few South Florida condo-buying tips to help you find your dream condo.
A condo is typically a shared piece of property with individual owners of each “unit” or condo. In most cases, condominiums offer services such as, but not limited to, fitness centers, tennis courts, and pools. Many people purchase condos due to less hands on maintenance and they enjoy lifestyle of living in a condominium community.
When buying a condominium, it is important you know that every condominium community is different. It’s crucial to know each community will have their own community rules, association fees, management company, and amenities.
Financial Strength
Take a close look at the health of the association just as closely as you do the unit itself. Associations should have reserve funds to maintain the parking lots, roofs, painting , pool and other maintenance items. If there are not enough funds to pay for the repairs, it would require a loan to the association which would be paid in monthly installments or a special assessment where all owners would have to pay their portion of the repair upfront. You should take this monthly condo association fee into consideration when planning to budget for your new home. If the association is not financially healthy, you will need to prepare to pay for unexpected expenses out of your own budget.
Building Style
The style of the building in which your condo is located in can impact your financial costs over time. Garden-style buildings have lower maintenance costs than towers. Multi-story buildings and towers have elevated costs associated with maintaining the elevator systems. The number of units and the size of the units within the association will also affect your maintenance dues. A larger number units divide the fees up between more people, lowering the cost than if you had a smaller amount of units .
Insurance
Depending on the exact location in South Florida, the cost of insurance varies. Research insurance costs and availability before signing the contract for your new condo. Beaches that are located on barrier islands offer additional challenges to obtain traditional all-perils insurance policies for both the association and the condo owner.
Beach Access/Condition
If you want to purchase a condo on the beach, you’ll need to consider the quality of the sand, the condition of the natural elements such as the dunes, and the width of the beach. Beach erosion is a common problem in Florida, especially after hurricanes and tropical storms hit. Take a deep dive into the history of the beach erosion and maintenance in the area you are looking to purchase your condo in. You certainly don’t want to purchase a condo on a beach that is eroding or isn’t properly maintained.
Mortgages and Financing
Financing a condo is not the same as financing a single-family residence. While it’s critical to get approved for a loan whether buying a condo or a house, obtaining financing can be trickier for a condo purchase, because many lenders don’t allow purchases of condos. Many condos are purchased with cash because of the regulations lenders and programs place. If you are looking to get an FHA loan, you’ll need to first make sure the condo community is on FHA’s approved list of communities. FHA typically requires that 80% of the units in the building are owner-occupied, so before you have your heart set on a property, double-check that it is on the approved list.
You can also obtain a private mortgage to purchase the condo, but this comes at a much higher price tag since many private lenders require a minimum of 20% down payment.Mortgages for condos may involve some additional steps. For condos, the condo association/complex must also be approved for a full loan approval to be issued, This may require additional paperwork, approval from the condo association, and even some additional costs paid before closing. You may need to make a bigger down payment or have extra cash in the bank since Lenders sometimes have extra requirements for condo buyers.
Association Fees
One of the largest expenses, in addition to your mortgage, will be your condo association dues. “Condo fees generally cover the maintenance of the common areas, utilities such as sewer and trash, security, building insurance, reserves and external building maintenance, In addition, whether the fees are paid monthly, quarterly, or annually, you will still be required to pay property taxes and need to carry homeowner’s insurance to cover your contents and your internal structure. Prospective condo purchasers should find out how much you will pay in monthly condo dues and what the fees cover within the community. Do these fees seem reasonable in return for the maintenance and amenities that are offered?
Rules and Regulations
Condo ownership comes with rules. It’s important that you understand what your unique responsibilities are to the overall community and what rules the condo association has in place. When you are buying a condo in Florida, you are required by law to receive a copy of the Declaration of the Condominium or condo docs as they are more commonly known – this is mandatory regardless of whether you are buying a resale condo, key-ready condo, or a per-construction condo. These condo docs are registered with the State and can be over 500 pages in length.
The condo docs will contain lots of specific information, including details about the developer, the formation of the Home Owners Association (HOA) and related fees, plans of the buildings, floor plans for each unit and the all important Rules and Regulations of the condominium.
Some Important information that you look for in the docs or ask for from the Condo Association:
  • What exactly are your ownership and voting rights within the association?
  • What percentage of the common expenses are you be liable for – many units offer different floor plans of various sizes, with each one making up a percentage
  • What restrictions are in place regarding the common elements and your unit?
  • Is there planning in place for further units to be constructed? Â If so, how many and when?
  • Does the developer have any options NOT to complete any of the facilities or amenities?
  • Is there a history of resident complaints at the condominium?
  • Is the Condominium Association currently involved in any form of litigation?
  • Does the Condominium Association have reserved funds set aside for maintenance projects and future capital expenditures?
  • What about pets – are there ANY restrictions?
  • Can you rent or sell your condo without restrictions?
  • Are there any restrictions regarding family and friends using, staying with, or occupying the unit?
Know About Special Assessments
A special assessment is a large fee that is charged to help pay for a significant project within the condo community, such as a structural repair. These special assessments can raise your association fees for a certain period of time or require a one time payment to the Association.

What Is Not Covered Under Standard Homeowners Insurance?

Sadly, too many people who experience disaster on a large or small scale may find the trauma continues when it’s time to file an insurance claim.
You need to be knowledgeable about what your Homeowner’s Insurance does and does not cover. These common held assumptions about insurance are items that are NOT covered and may require additional insurance or riders.
Wear and Tear Is Covered-Myth
Fact: Coverage typically includes damage from fire, weather and theft, not damage due to general wear and tear or neglect. As a policyholder it’s up to you to maintain your home, including making routine repairs and protecting your home from pests. If you neglect to take care of your property ( a leaky roof) you may not be covered.
You’re Insured in Case of Flood Damage, Earthquakes, Tornadoes and Hurricanes-Myth
Fact: Although some weather-related damage is generally covered, such as from hail, other storm related damage from wind or water may not be.
Floods require specific flood insurance from the Federal Government. Earthquakes might be covered, but sometimes they require additional insurance. Hurricane and tornado damage requires a separate windstorm policy. Sinkholes, mudslides and other earth movement (except in CA) requires a separate endorsement.

Fact: Homeowners insurance typically covers furniture, clothing and other personal items, but more valuable items like jewelry and artwork may require an add-on policy. Homeowners should routinely inventory belongings to determine if policy limits meet their coverage needs.

You Can Rebuild For The Amount Of The Insurance Coverage-Myth
Fact: Unless you insured for “replacement value” you may be under insured to rebuild your home. “Ordinance of Law” exclusions may not cover to the changes to building codes and the additional costs of bringing the property up to code if damaged.

It may not seem like particularly interesting reading material, but it’s better to take the time to thoroughly understand what your insurance policy covers than to be stuck in a situation where you’re not sure when you really need it.

ALINA Residences is currently under construction on more than 8 acres on Southeast Mizner Boulevard in Downtown Boca Raton.  This luxury development is one of Palm Beach County’s latest new construction projects in South County.  The development will include a nine-story building with 121 condos, 102 of which will be fully furnished and 12 will be penthouses.  The units will range from one to four bedrooms ranging in size from 1400 to more than 4,800 square feet overlooking the Boca Raton Golf Club.  Alina will include seven villas with lanais and private gardens.

There are several advantages of using a self-directed IRA or Solo 401(k) plan to buy real estate. The first is tax deferral or tax-free growth. For example, if one purchased a piece of property with retirement funds for $80,000 and later sold the property for $300,000, the $220,000 of gain appreciation would generally be tax-deferred. Whereas, if you purchased the property using personal funds (non-retirement funds), the gain would be subject to federal income tax, and in most cases, state income tax. Second, a self-directed IRA can allow you to invest in hard assets you know and understand, such as a rental property or piece of land. Lastly, having the ability to invest in alternative assets is believed to be a good source of investment diversification.
Real Estate Investment Trusts (REITs)
If you are looking for easy transactions both in and out, REITs provide that. Many REITs are registered with the SEC and are publicly traded on a stock exchange. These are known as publicly traded REITs. Others may be registered with the SEC but are not publicly traded. These are known as non- traded REITs (also known as non-exchange traded REITs).
All REITs have their own specialties, so make sure you do your due diligence on the company. REITs are required to distribute 90% of its taxable income as dividends, so many retirees look to REITs for income.

You can also invest in rental properties. You can buy distressed properties, rehabthem and rent them out or you can buy performing ones. If you decided that you want to go the distressed route you’ll have to keep a very close eye on the accounting. There are lots of rules in regards to tracking the money. You can either manage them on a daily basis or go through the process of hiring a property manager to manage it for you. This is a good way to build a passive income stream.
Turnkey Real Estate Investment
Turnkey is another viable option for SDIRA owners. Self-directed IRA (SDIRA) is another option for an IRA holder, which allows them to invest in diversified assets. To expand on “diversified assets,” this means that you aren’t restricted to stocks and bonds like most IRAs. You are able to invest in many different things. SDIRA serves as a savings account where your money can grow tax-free until you withdraw the funds, unless it is a Roth IRA. If it is a Roth IRA, the money is taxed prior to going into the account and when it is withdrawn, it is tax-free.
The owner simply transfers funds from his/her IRA or other retirement account to SDIRA. Many of them increase the amount invested with their personal contributions to the account.
A Turnkey Real Estate investment basically means that you are working with a turnkey investment company that are selling rental properties. Most of these investment properties are already rehabbed and rented out. You just need to buy the property and everything else in managed by the turnkey company. This is the best option for out-of-state investorsor someone who’s not interested in buying, rehabbing or managing the property. You’ll get the rent every month and you’ll pay a portion of that to your turnkey company for managing the properties. It is a easy hands off approach to investing in real estate.

What Home Buyers Can Learn From a Seller’s Disclosure Statement

Any responsible buyer wants to know everything about the home they’re buying before signing on the dotted line. After all, this is probably the biggest purchase you will ever make, so due diligence is a must. The majority of the real estate agents in Florida are Transactional Agents and do not owe the Buyer a fiduciary duty, An Exclusive Buyer Agent does and will work for the buyer to determine all the information known about the property and advise you on inspections, permit searches, etc. Reviewing the Seller’s Disclosure is the first step in this process.

A Seller’s Disclosure in the State of Florida Is a standard form that is essentially a checklist in which a seller indicates the condition of the different features of a property, any known problems affecting the property, and any pending legal issues. This could include things like knowledge of lead-based paint, water damage, pest damage, past repairs, past insurance claims, any history of property line disputes, etc.

Typically, a seller’s disclosure form is filled out by the seller along with their listing paperwork. When buyer’s agents go into the Multiple Listing Service (MLS) to look up potential properties for their clients, that disclosure statement should be available or can be requested from the listing agent.

I am increasingly running into situations wheretransactional brokerage firms are taking the position that since a Seller’s Disclosure is NOT required by law that are not asking the sellers of their listings to fill one out. The first line of the SPDR provides “Notice to Licensee and Seller”; the less they know, the easier it is to make a “deal”. They are relying on the fact that other transactional agents working with buyers will feel the same and not ask for a Sellers Disclosure.

Although sellers aren’t required to complete this specific SPDR form, a residential seller does have to comply with the rule established in Johnson v. Davis. In that case, the Florida Supreme Court held that “where the seller of a home knows of facts materially affecting the value of the property which are not readily observable and are not known to the buyer, the seller is under a duty to disclose them to the buyer.” These material facts are sometimes referred to as latent defects. In addition, in Rayner vs. Wise Realty Co. of Tallahassee, the First District Court of Appeal provided that this same disclosure requirement applies to residential properties that are being sold as is.

In cases were the listing agent does not provide a Sellers Disclosure I request that the Seller answer all my questions in writing and provide a comprehensive list of questions that encompasses everything asked on the SPDR and more.

A seller’s disclosure form is NOT a substitute for a home inspection. Remember, sellers are required to disclosure only problems they know about. Most homeowners don’t go in their attic very often, and have probably never been up on their roof, and they aren’t required to do so before filling out the disclosure. While this document can provide a lot of valuable information, the home inspection is another layer of protection for a buyer.

The importance of this disclosure statement is just one of the many reasons why it’s critical for buyers and sellers to use an Exclusive Buyer Agent ( EBA) during any real estate transaction. EBAs are up-to-date on the latest laws and regulations and are very experienced with the complex documents and paperwork. They can help walk buyers through the disclosure so they understand all aspects of the home they’re buying and recommend the appropriate home inspections ( WDO, Radon, Leak Testing, Mold, and more) to ensure that any hidden defects are found in advance of the purchase.

It’s a time to look ahead, to make new plans, to achieve new dreams. If those dreams include buying your own home, you should keep an eye on the ever-changing tides of the housing market. Now, markets are like the weather: You can’t entirely predict how they will act, but you can get a sense of the forces that will push things in one direction or another.
There will be more homes for sale, especially in luxury markets
There has been a tight inventory of homes for sale for several years now and homes have been hitting the market, but not enough to keep up with the demand. Nationwide, inventory actually hit its lowest level in recorded history last winter, but this year it finally started to recover. Inventory growth is expected to continue into next year, but not at a blockbuster rate—less than 7%. This is welcome news for buyers.
Affording a home will remain difficult
Life is also going to be more difficult for home buyers, because mortgage rates are expected to continue to increase, as well as home prices, so the pinch that buyers are feeling from affordability is going to continue to be a pain point moving into 2019.
Mortgage rates, now hovering around 5%, are projected to reach around 5.8% by the end of 2019. That means the monthly mortgage payment on a typical home listing will be about 8% higher next year. Meanwhile, incomes are only growing about 3% on average. That double whammy is toughest on first-time home buyers, who tend to borrow the most heavily and who don’t have any equity in a current home to draw on.
Millennials will still dominate home buying
Just a few years ago, Millennials were the new kids on the block, just barely old enough to buy their own homes. Now they’re the biggest generational group of home buyers, accounting for 45% of mortgages (compared with 17% for baby boomers and 37% for Gen Xers). Some of them are even moving on up from their starter homes.
At the time of last year’s forecast, the GOP’s proposed revision of the tax code was still being batted around Congress. While there was talk that it might discourage people from buying a home, no one really knew how it might affect the real-estate market.
This year … well, we still don’t really know. That’s because most taxpayers won’t be filing taxes under the new law until April 2019. And while some people might have a savvy tax adviser giving them a better idea of what’s in store, for many, the reality check will come in the form of a bigger tax bill—or a bigger refund.
Renters are likely to have lower tax bills, but might not be tempted to buy while affordability remains a challenge, and with the new, increased standard deduction reducing the appeal of the homeowner’s mortgage-interest deduction.
“I think the new tax plan will affect mostly homeowners and home buyers in the upper parts of the distribution,” says Andrew Hanson, associate professor of economics at Marquette University in Milwaukee, WI. “Those who either own or are buying higher-priced homes are going to pay a lot more.”
The biggest change resulting from the new tax law, Hanson predicts, will be in mortgages, since people will be less inclined to take out large mortgages.
